Terms of Service
These terms are an agreement between you and POLIGON TECH S.R.L. (Trade Register J2021001011338, CUI RO44336321, registered office Cajvana nr. 797, jud. Suceava, 727100, Romania) ("we", "us"), for the use of RightSide during its closed beta. RightSide lets your coding agents build, deploy and operate web apps through the rightside CLI and the rightside-mcp server. By creating an account, approving an agent, or using the service, you accept these terms.
In short
- RightSide is a free, invite-only beta. It can change, break or stop, and there is no uptime guarantee.
- You own your code and content. You give us only the rights we need to host it.
- Your agents act for you. You are responsible for what they deploy and for keeping your credentials safe.
- Follow the Acceptable Use Policy. Your privacy is covered by the Privacy Notice.
1. Eligibility
RightSide is available by invitation only. You may use it if you have been invited, you are at least 18, and you can enter a binding contract. If you use RightSide for an organisation, you confirm that you may accept these terms for it, and "you" includes that organisation. You may not use RightSide if you are barred from doing so by sanctions or other applicable law.
2. Your account, your agents and your credentials
- You sign in with GitHub or with a code sent to your invited email address. Keep your account details accurate.
- When you run
rightside loginand approve it in your browser, you give that device, and every coding agent that uses it, permission to act on your account within the permissions shown. Anything done with your credentials counts as done by you, including actions your agent takes on its own. - Keep your credentials private. Do not paste them into chats, prompts, repositories or logs. Revoke a credential in the Apps Console, or contact us, as soon as you suspect it has leaked.
- Review what your agent deploys. You are responsible for your apps, including their security, their content and how they treat personal data.
3. Acceptable use
You must follow the Acceptable Use Policy, which is part of these terms. It prohibits, among other things, phishing, malware, spam, crypto mining, attacks, illegal content and attempts to break the isolation between apps.
4. Your content
You keep all rights in the code, files, data and other content you or your agents upload or that your apps produce ("your content"). You give Poligon Tech a worldwide, non-exclusive, royalty-free licence to store, copy, build, run, transmit and display your content, only as needed to provide, secure and support RightSide for you, and to comply with the law. This licence ends when your content is deleted from our systems. During the private beta there are no backups, and beta data may be erased before the public launch, so keep your own copy.
You confirm that you have the rights needed to upload your content and to let us host it, and that it does not breach the Acceptable Use Policy. If your apps process personal data of other people, you are the controller and we are your processor. The Data Processing Addendum applies to that processing.
5. Our service and software
RightSide, including the CLI, the MCP server and the platform, belongs to Poligon Tech. During the beta we give you a personal, non-exclusive, non-transferable, revocable right to use it to deploy and run your own apps. You may not copy, resell, sublicense or provide RightSide to third parties, or reverse engineer it except where the law allows. Good-faith security research under our security policy is permitted. If you send us feedback, we may use it without obligation to you.
6. Beta service: no SLA
RightSide is a beta. It may contain bugs, may lose data, and may be unavailable. There is no service level agreement and no uptime guarantee. We may change, add or remove features, limits and supported configurations, reset beta data after giving notice, or end the beta. Do not use RightSide as the only place you keep anything important. Keep your own copy of your source code and data.
7. Fees
The beta is free of charge. If we introduce fees, we will tell you at least 30 days in advance by email, and you will not be charged unless you accept the new terms. You may stop using RightSide instead.
8. Suspension and termination
- You may stop using RightSide at any time and ask us to close your account by emailing [email protected].
- We may suspend or disable an app or your account, and revoke its credentials, if you breach these terms or the Acceptable Use Policy, if your use creates a security risk or harms other customers or the platform, if we must do so by law, or in a security emergency. We will normally warn you first and explain why, unless it is urgent or the law prevents it.
- We may end your access to the beta, or end the beta itself, for any reason with at least 30 days' notice, or sooner for the reasons above.
9. Your data when the service ends
Your source code lives with you, and your agent can retrieve build logs and release history while your account is active. When your account closes for a reason other than a serious breach, you will have at least 30 days to retrieve anything you need, and we will help on reasonable request. After that we delete your account and content as described in the Privacy Notice. We may keep data longer where the law requires it, or to deal with abuse.
10. Disclaimers
To the extent the law allows, RightSide is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and that it will be uninterrupted, secure or error-free. We are not responsible for the code your agents write or deploy, or for how third-party services such as GitHub or your agent's provider behave.
11. Limitation of liability
To the extent the law allows, Poligon Tech is not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill. Because the beta is free, our total liability for all claims arising from RightSide is limited to [amount, e.g. EUR 100 — confirm with counsel]. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for damage caused intentionally or through gross negligence.
12. Indemnity
If a third party makes a claim against Poligon Tech arising from your content, your apps, or your breach of these terms or the Acceptable Use Policy, you will indemnify us against the resulting losses and reasonable costs, as far as the law allows. We will tell you promptly about the claim and let you take part in the defence.
13. Governing law and courts
These terms are governed by Romanian law. The competent courts of [city of registered office, e.g. Bucharest — confirm], Romania, have jurisdiction over any dispute, unless mandatory law gives you the right to go to court elsewhere. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
14. Changes to these terms
We may update these terms as RightSide develops. We will change the date at the top and, for material changes, email you at least 14 days before they take effect, unless the change is required by law or needed urgently to address security or abuse. If you keep using RightSide after a change takes effect, you accept the new terms. If you do not agree, stop using RightSide and ask us to close your account.
15. General
If any part of these terms is invalid, the rest remains in force. If we do not enforce a right straight away, we do not give it up. You may not transfer these terms without our consent. We may transfer them to a successor of the RightSide business. These terms, together with the Acceptable Use Policy, the Privacy Notice and any signed DPA, are the whole agreement between us about RightSide.
